Kari Sellars Photography Contract and Model Release Form
This agreement is between the client booking the photography session and any family members participating in the photography session (herein after referred to as the “Client”), and  Kari Sellars Photography (herein after referred to as the “Photographer”)
By booking with Kari Sellars Photography, you enter into a contract and have therefore agreed to abide by the following terms and conditions

Entire Agreement:
This agreement contains the entire understanding between the Client and the Photographer.

The Client and the Photographer consent to happily cooperating and communicating with each other to achieve the best possible result within the understanding of this contract.

Who is included in the Photography Sessions:
As a rule, Family & Maternity Outdoor Sessions are limited to immediate family members only (2 adults and children), unless previously agreed by The Photographer.
Newborn Lifestyle Sessions are limited to immediate family only (2 adults and children).
Lace, Milk & Honey Sessions are for mum only.
Mini Sessions are limited to those people specified in the description of the mini session (eg Mummy and Me sessions are just for mum and children).

Copyright Law:
The copyright of photographs remains with the Photographer. The Photographer grants the Clients permission to make copies of the images under the following conditions; the images taken by the Photographer are for personal use by the Clients and their friends and relatives. Sale, Publication or any commercial use of the photographs is not allowed without prior written permission from the Photographer.
Alteration of any images handed to the client is strictly forbidden by anyone other than the original Photographer, you may not pass copies of any images to any other professionals without the prior consent of the Photographer, and then if permission is granted only small file watermarked versions can be shared and the said professionals must link back to www.karisellars.com

RAW images will remain the property of the Photographer and cannot be transferred to the Client or purchased.

Model Release:
The Client grants the Photographer and its legal representatives, heirs and assigns, the irrevocable and unlimited consent to use the photographs of the Client for editorial, competition, advertising and any other purpose and in any manner, to alter the photographs without restriction; and to full copyright of the images.
The Client hereby releases the Photographer and its legal representatives, heirs and assigns from all liability and claims in connection with the images.

The Photographer has full rights to make the selection of the images that she feels are the images that reflect her style and quality of work. During the image selection process, any images that are not suitable for selection are removed and not available to the client. The Photographer is allowed to have full artistic licence with editing.

20-30 edits are normally provided for the Client’s gallery, this is not a guaranteed minimum though, as working with very young children can be unpredictable.

Alteration of any images handed to the Client is strictly forbidden by anyone other than the Photographer. If the Client makes a request for further editing, by the Photographer, additional costs may be incurred.

Editing time after the session can be up to 8 weeks at busy periods, but is usually less.

As the Client, please ensure you look the way you would like to in the photos before the session. The Photographer cannot be held responsible for adjusting your hair or clothing to ensure it is perfect to you, as every person prefers something different.

Sale Items:
Kari Sellars Photography reserves the right to reduce the cost of sessions or digital files at times throughout the year as an “offer” or “sale” if you have paid full price for a session or digital files at another date, it is not possible to then receive the discounted price for items previously purchased at an earlier date, this includes (but not limited to) gift vouchers and advance bookings.

Purchase of Digital and Printed Photographs
The Client selects the digital images and prints they would like to purchase via a password protected online gallery.
Once the Client has paid in full for their selected digital images and they have been dispatched (via email or USB), they are completely non refundable.
Prints purchased / included in packages are checked to ensure they are of the highest quality, before being dispatched to the Client by the Photographer. Due to the nature of photographic prints, these are also non refundable.

Limit of Liability:
If the Photographer is unable to attend / carry out a session on the agreed date, for any justifiable reason, including but not limited to weather, illness or injury, a convenient reschedule date will be offered to the Client.
If the Client does not choose to reschedule, they may request a refund for any session fees already paid.
The Photographer cannot be held liable for any loss of earnings incurred by missed sessions.
The Photographer will always do all they reasonably can to ensure we gain the best from your session and from each person, however, if child / adult is non compliant for any reason and where as a result, the images the Client desires or expects are not achieved, The Photographer will not be held responsible and session fee is non-refundable.
In the event of creative differences, the Photographer may terminate the session and retain the full session fee.
Fees are also non refundable in the event a client does not like their images for any other reason.

In the event of the Client cancelling within 14 days of booking a session, the session fee is fully refundable, unless the session is cancelled with less than 48 hours notice of the session.
It will be considered as liquidated damages to the Photographer, if the session is cancelled with less than 48 hours notice and the full basic session fee will be retained to cover the loss of bookings for that date.
If the Client arrives 30 minutes or more late to their agreed session time, the session will be cancelled and the session fee retained. Should the Client wish to reschedule, they may do so, at additional session fees.
